These Terms and Conditions ('Terms') govern your use of the Artcrafture platform and services. By accessing or using our website at www.artcrafture.com (the 'Platform'), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform.

You must be at least 18 years old to use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts.
To access certain features of the Platform, you must create an account. You agree to:
Artcrafture operates as an online marketplace connecting Artists and Collectors. We facilitate transactions but are not a party to the contracts between Artists and Collectors unless explicitly stated otherwise.
Artcrafture may also sell artwork directly, having procured items from Artists or other sources. In such cases, Artcrafture acts as the seller and is party to the sales contract with the Buyer.
Artists may sell their artwork through the Platform on a commission basis. The commission structure is as follows:
Artworks may be available for rental. Rental terms include:
Collectors may commission custom artwork from Artists through the Platform. The Artist and Collector agree on specifications, timelines, and pricing. Artcrafture facilitates the transaction and may charge a service fee of 10-15% of the commission value.
Artists may create virtual galleries to showcase their work. Gallery features are included in artist membership subscriptions.
Artcrafture may organize or promote cultural events, exhibitions, and workshops. Ticket purchases and event participation are subject to specific event terms communicated at the time of registration.

As an Artist using the Platform, you agree to:
For commission-based sales, Artists will receive payment within 14 business days of the Buyer confirming receipt of the artwork, minus applicable commission fees and any transaction costs. Payment will be made via bank transfer to the Artist's registered account.
Artcrafture reserves the right to review and approve all artwork listings and artist profiles to ensure quality and compliance with our standards. We may refuse or remove listings that do not meet our quality standards, contain prohibited content, or violate these Terms.
When you purchase artwork through the Platform, you enter into a binding contract. All purchases are subject to acceptance and availability. Prices are as displayed on the Platform and include applicable VAT unless otherwise stated.
After placing an order, you will receive an order confirmation email. This confirmation does not constitute acceptance of your order; it is merely confirmation that we have received it. We reserve the right to refuse or cancel any order for any reason.

We accept payments through our payment gateway providers: Paytrail and Klarna. All payments must be made in Euros (EUR). We do not store your payment card details; all payment information is handled securely by our payment processors in compliance with PCI DSS standards.
All prices displayed on the Platform include Finnish VAT (25,5% or applicable rate) unless otherwise stated. For international sales, additional customs duties, taxes, or import fees may apply and are the responsibility of the Buyer.
Payment must be received and cleared before artwork is shipped. If payment fails or is declined, your order may be cancelled.
We ship to addresses in Europe, North America, and other international locations as specified during checkout. Shipping is handled through courier services, and for certain regions in Finland (Uusimaa, Varsinais-Suomi, Kanta-Häme, Päijät-Häme, Kymenlaakso, Pirkanmaa), delivery may be made directly by Artcrafture.
Shipping costs are calculated at checkout based on the destination, size, and weight of the artwork. These costs are in addition to the artwork price.
Estimated delivery times are provided at checkout and are approximate only. We are not liable for delays caused by courier services, customs processing, or events beyond our control.
All shipments are insured against loss or damage during transit. In the event of damage or loss, we will work with the courier and insurance provider to resolve the issue.
For international shipments, the Buyer is responsible for any customs duties, import taxes, or fees imposed by the destination country. These charges are not included in the purchase price or shipping costs.
In accordance with EU Consumer Rights Directive (2011/83/EU) and Finnish Consumer Protection Act, EU consumers have the right to cancel their purchase within 14 days of receiving the artwork without providing a reason. To exercise this right, you must notify us in writing at hello@artcrafture.com within the 14-day period.
The right of withdrawal does not apply to:
To return an item, you must return it in its original condition, unused and with all original packaging. You are responsible for the cost of return shipping unless the item is defective or we made an error. Upon receiving and inspecting the returned item, we will process your refund within 14 days.
If you receive damaged or defective artwork, you must notify us within 48 hours of delivery with photographic evidence. We will arrange for replacement, repair, or full refund at no cost to you, including return shipping.
Refunds will be issued to the original payment method used for the purchase. Processing time may vary depending on your financial institution.
Artists retain all intellectual property rights to their artwork, including copyright. By listing artwork on the Platform, Artists grant Artcrafture a non-exclusive, worldwide license to display, promote, and market the artwork on the Platform and in marketing materials.
When you purchase artwork, you acquire ownership of the physical item but not the intellectual property rights unless explicitly agreed otherwise with the Artist. You may not reproduce, distribute, or commercially exploit the artwork without the Artist's permission.
The Platform, including its design, text, graphics, logos, and software, is owned by Artcrafture and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without our written permission.

To exercise any of these rights, please contact us at hello@artcrafture.com. We will respond within one month. You also have the right to lodge a complaint with the Finnish Data Protection Ombudsman (Tietosuojavaltuutettu) if you believe your data protection rights have been violated.
We retain your personal data only as long as necessary for the purposes for which it was collected, including to comply with legal, accounting, or reporting requirements. Transaction records are retained for 6 years in accordance with Finnish accounting law.
We primarily store data within the EU/EEA. If data is transferred outside the EU/EEA, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses approved by the European Commission.

We strive to keep the Platform available and functional but do not guarantee uninterrupted or error-free service. We are not liable for any loss or damage arising from platform downtime, maintenance, or technical issues.
For commission-based sales, Artcrafture acts as an intermediary. We are not responsible for the quality, authenticity, legality, or delivery of artwork sold by third-party Artists, except where we are the direct seller. Disputes between Buyers and third-party Artists should be resolved directly between the parties.
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim. This limitation does not apply to liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in prohibited conduct. You may also terminate your account at any time by contacting us. Upon termination, you remain liable for any outstanding obligations, and certain provisions of these Terms (including intellectual property, liability, and dispute resolution) will survive.

EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/. Finnish consumers may also contact the Consumer Disputes Board (Kuluttajariitalautakunta).
These Terms are governed by the laws of Finland. Any disputes will be subject to the exclusive jurisdiction of the courts of Helsinki, Finland, except where mandatory consumer protection laws provide otherwise.
We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of war, terrorism, strikes, pandemics, or government actions.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Artcrafture regarding your use of the Platform and supersede any prior agreements.
